The following Privacy Policy describes how we gather information from our customers and other visitors, the types of information we gather, how we use it, and how we protect it. If you have any questions or concerns regarding this policy, you may contact us at any time.

We will not sell, share, or rent your information to others in any ways different from those disclosed in this Policy.

YOUR CALIFORNIA PRIVACY RIGHTS

“Do Not Track” (or DNT) is a preference you can set in your browser to let the websites you visit know that you do not want them to collect information about you. If you do not want your personal information shared with third parties for this purpose, you can opt out by contacting us.

We do not support “do not track” requests.

WHAT INFORMATION WE COLLECT

We gather and store the information you enter on our web site or give us in other ways. You can choose not to provide certain information, but you may not be able to take advantage of key features of online shopping.

To process your order, we require you to supply us with your billing (credit card), shipping and contact information (email address and phone number). The transfer of this information is secure and cannot be received or read by others. Your credit card information is only shared with our bank for authorization.

WHY WE COLLECTION INFORMATION

We gather information about you so that you may quickly navigate our site for products of interest and to place orders. We also gather information so that we can improve your experience at this website. By collecting information, we are able to offer you features (such as login and password information) that save you time during the order process.

HOW WE COLLECT INFORMATION

When you create your account, and during the order process, you are prompted to supply us with your contact, billing, and shipping information. This information must be provided in order to complete a purchase and is used to complete your order and contact you regarding your order.

COOKIES

We also use cookies to collect information from you. Cookies are pieces of information stored locally on your computer that are used by us and by third parties (see Google Analytics, below). We use first party cookies to identify how you arrived at our site. A cookie identifies you while you are at our site and keeps track of items in your shopping cart between visits. We use this information to view bounce rates, content consumed, time on site, cart/conversion activity and more.

Cookies never contain credit card information.

USE OF INFORMATION WE COLLECT

GOOGLE ANALYTICS

We use Google Analytics and other similar services to track website visitor activity at both the aggregate and individual level. We’ve enabled user ID tracking in Google Analytics, which allows Google to track your web activity and online behavior. However, the user ID is still anonymous to us. Google uses this information to personalize advertisements to you for goods and services.

THIRD PARTIES

We engage third parties to perform services such as payment processing and authorization, fraud protection and credit risk reduction, product customization, order fulfillment and shipping, marketing and promotional material distribution, web site evaluation, data analysis and, where applicable, data cleansing. We provide your personal information to these third parties, but we authorize them to use this information only in connection with the services they perform.

EMAILS

We use your email address to send order confirmation emails and invoices. If you have selected to receive our weekly email specials by supplying your email address, we will send you our exclusive weekly specials. You can opt out of receiving promotional emails from us by clicking “unsubscribe” at the bottom of any email.

CHANGE YOUR INFORMATION

You can contact us anytime to modify your personal information. We cannot change your personal information over the phone. Additionally, you have the ability to change your personal information any time you log into your account.

OPT OUT

You may, at any time, opt out of receiving communications from us, either by clicking “unsubscribe” at the bottom of any e-mail or you can contact us directly and we will take care of it for you immediately.

This website may contain links to other sites. We are not responsible for the content or privacy practices of such other sites.

SECURITY

We have implemented systems and procedures to secure the information we collect online. For example, we protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts the information you input. This industry standard encrypts all of your information, including credit card numbers, so that it cannot be read by others as the information is exchanged via the Internet. Additionally, it is important for you to protect against unauthorized access to your password and to your computer. If you use a shared computer, be sure to sign off and close all browsers when you are finished.

At Statesman Cigar Co., we value the privacy of our customers and business contacts.  In this Privacy Policy, we provide information to California residents (“you”) about our collection, use, disclosure, and other processing of information that can be reasonably linked with them (“Personal Information”).

This California Privacy Policy supplements our general privacy policy.  In the event of a conflict between this California Privacy Policy and our general privacy policy, with respect to California consumers, this California Privacy Policy will take priority.

Collection and Disclosure of Personal Information

The following chart details which categories of Personal Information we collect and process, as well as which categories of Personal Information we disclose to third parties for our operational business purposes, including within the 12 months preceding the date this Privacy Policy was last updated.

We may also disclose your Personal Information to a third party in the event of any reorganization, financing transaction, merger, sale, joint venture, partnership, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

We do not sell or share or otherwise process Personal Information for purposes of cross-context behavioral advertising, as defined under applicable law.  We have not engaged in such activities in the 12 months preceding the date this Privacy Policy was last updated.   Without limiting the foregoing, we do not knowingly sell or share the Personal Information of minors under 16 years of age.

Use of Sensitive Personal Information 

Subject to your consent where required by applicable law, we may use Sensitive Personal Information for the limited purposes outlined above in the Sensitive Information section in our general privacy policy.  In addition, we may use Sensitive Personal Information, in certain circumstances, for verifying your age.

Purposes for the Collection, Use, and Disclosure of Personal Information

We may collect, use, or otherwise disclose Personal Information for the purposes outlined above in the How We Use Your Information section in our general privacy policy.

Retention Period. We retain Personal Information for as long as needed or permitted in light of the purpose(s) for which it was collected.  The criteria used to determine our retention periods are outlined above in the Retention Period section in our general privacy policy.

 

Individual Requests

If you are a California consumer you may, subject to applicable law, make the following requests:

1.       You may request to know whether we process your Personal Information, and to access such Personal Information.

a.       You may request that we disclose to you the following information covering the 12 months preceding your request:

                                                               i.      The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;

                                                             ii.      The business or commercial purpose for collecting Personal Information about you; and

                                                            iii.      The categories of Personal Information about you that we disclosed, and the categories of third parties to whom we disclosed such Personal Information (if applicable).

2.       You may request to correct inaccuracies in your Personal Information.

3.       You may request to have your Personal Information that we collected from you deleted.

4.       You may request to receive a copy of your Personal Information, including specific pieces of Personal Information, including, where applicable, request to obtain a copy of your Personal Information in a portable, readily usable format.

We will not unlawfully discriminate against you exercising your rights under California law. To make a privacy request, please contact us at info@statesmancigarco.comWe will verify and respond to your request consistent with applicable law, taking into account the type and sensitivity of the Personal Information subject to the request. In some instances, we may decline to honor your request where the law or right you are invoking does not apply or where an exception applies. We may need to request additional Personal Information from you, such as your full name, telephone number or email address, in order to verify your identity and protect against fraudulent requests. If you maintain a password-protected account with us, we may verify your identity through our existing authentication practices for your account and require you to re-authenticate yourself before disclosing or deleting your Personal Information.  If you make a request to delete, we may ask you to confirm your request before we delete your Personal Information.

Authorized Agents

If an agent would like to make a request on your behalf as permitted under applicable law, the agent may use the submission methods noted in the section entitled “Individual Requests” or may submit such requests at info@statesmancigarco.com.  As part of our verification process, we may request that the agent provide, as applicable, proof concerning his or her status as an authorized agent. In addition, we may require that you verify your identity as described in the section entitled “Individual Requests” or confirm that you provided the agent permission to submit the request.

If you are a California consumer and an agent makes a request on your behalf, this may include:

1.       A power of attorney provided to the agent by you pursuant to California Probate Code sections 4121‑4130.

2.       If you have not provided a power of attorney according to item (1) above:

a.       We may require proof that you have provided signed permission authorizing the agent to make a request on your behalf.  “Signed” means that the permission has either been physically signed or provided electronically in accordance with the Uniform Electronic Transactions Act, Civil Code 1633.7 et seq.

b.       We may require you to:

                                                         i.            Verify your own identity directly with us; or

                                                       ii.            Directly confirm with us that you provided you permission to submit the request.

 

De-Identified Information

Where we maintain or use de-identified data, we will continue to maintain and use the de-identified data only in a de-identified fashion and will not attempt to re-identify the data.

Response to “Do Not Track” Requests/Signals

Some web browsers may transmit “do-not-track” (“DNT”) signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not change our tracking practices in response to DNT settings in your web browser.

NOTIFICATION OF CHANGES

We may change this Privacy Policy from time to time. If we make material changes to this Policy, we will update this page and the effective date listed below.
